Competency Evaluations 

A competency evaluation may be court-ordered or requested by a doctor, attorney, family member or the patient to determine if he or she has the capacity to make reasoned decisions. 


The examiner evaluates the patient's mental health, cognitive functioning, memory capacity, and decision-making ability. These factors are important in determining whether an individual needs a guardian or is competent to make decisions such as executing a will, determining medical directives relating to long-term care, assigning power of attorney or opening a trust account.
